Zgodnie z projektem państwo organizuje kompetencyjny egzamin prawniczy (KEP) sprawdzający zarówno wiedzę, jak i umiejętności. Osoby, które uzyskają wymagane minimum punktów, mogą przystąpić do korporacji zawodowej adwokatów.

Projekt eliminuje utrudnienia w dostępie do zawodu adwokata: przystąpienie do egzaminu kompetencyjnego nie wymaga odbycia formalnej aplikacji, praktyki ani szkolenia. Uzyskanie pełnych uprawnień do reprezentacji wymaga jednak odbycia rocznego kursu praktycznej nauki zawodu adwokata, organizowanego przez izby adwokackie już po zdaniu kompetencyjnego egzaminu prawniczego.

Ustrój nowej adwokatury opiera się na znacznie większych i silniejszych niż dotychczas 11 izbach adwokackich (obecnie 24). Zunifikowana adwokatura jest samorządna i niezależna od państwa.

Sądownictwo dyscyplinarne w pierwszej instancji należy do korporacji, a w drugiej do sądów powszechnych (11 sądów apelacyjnych) orzekających w składach mieszanych (dwóch sędziów zawodowych + jeden adwokat). Sąd II instancji weryfikuje orzeczenia sądu I instancji co do ustaleń faktycznych i prawnych. Przysługuje skarga kasacyjna do Sądu Najwyższego.

Projekt wprowadza instytucję zawodowych rzeczników dyscyplinarnych. Adwokaci wybrani przez Naczelną Radę Adwokacką na stanowisko rzecznika dyscyplinarnego nie wykonują zawodu i kierują biurem rzecznika.

Dodatkowo projekt zakłada możliwość wykorzystania pewnych jego elementów w reformie innych zawodów prawniczych: np. sędziowskiego, notarialnego, prokuratorskiego, referendarskiego (zastąpienie egzaminów wstępnych na aplikacje kompetencyjnym egzaminem prawniczym).

Wśród wielu uwag sformułowano kilka bardzo doniosłych. Należy do nich propozycja uwzględnienia w projekcie reformy zawodów prawniczych zawodu prokuratora i sędziego. Takie stanowisko wyrazili podczas spotkania z nami, między innymi, posłowie Platformy Obywatelskiej zainteresowani projektem (Cezary Grabarczyk, Janusz Palikot), ale i inni komentatorzy, np. mec. Witold Daniłowicz (White&Case) podczas spotkania w Instytucie Spraw Publicznych, gdzie ogłosiliśmy projekt.

Projekt uwzględniający dochodzenie do prawa wykonywania zawodu prokuratora i sędziego miałby jeszcze bardziej całościowy i systemowy charakter, a wydaje się, że zaplanowane przez nas w projekcie Nowa Adwokatura niektóre elementy, mogą być wykorzystane także w reformie zawodów prokuratora i sędziego.

W związku z tym obecnie prowadzimy prace nad sformułowaniem dodatkowych założeń. Można będzie je traktować jako dopełnienie wcześniejszego projektu. Można także będzie poprzestać na założeniach dotychczasowych, decydując się na nierozszerzanie projektowanych zmian na kolejne zawody, i poprzestanie na regulacji zawodów polegających na świadczeniu usług prawnych i dokonywaniu czynności notarialnych.
